Terms of Service
These Terms of Service (“Terms”) govern your use of the Shelfling mobile application, website at shelfling.app, and related services (collectively, the “Service”). By downloading, accessing, or using the Service, you agree to these Terms.
1. The Service
Shelfling helps families track reading, celebrate milestones, and discover books. Features may include local library management, growth experiences, optional cloud or classroom tools, and optional AI-assisted features. We may change, add, or remove features as we improve the product, consistent with applicable law and any paid subscription you have.
2. Who may use Shelfling
You must be legally able to form a binding agreement in your jurisdiction. If you use Shelfling on behalf of a child, you represent that you are the parent or legal guardian, or have appropriate authority (for example as an educator with consent). You are responsible for activity under your account and for how profiles you create are used.
3. Accounts and security
You may need an account for certain features. You agree to provide accurate information and keep credentials confidential. Notify us at hello@shelfling.app if you suspect unauthorized access.
4. Content you provide
You retain rights to content you submit (for example notes, quotes, or photos). You grant Shelfling a worldwide, non-exclusive license to host, process, display, and back up that content solely to operate and improve the Service for you. You represent you have the rights to submit the content you upload.
5. Acceptable use
You agree not to misuse the Service, including: violating law; harming or harassing others; attempting to access others’ data without permission; reverse engineering except as permitted by law; interfering with security or performance; using the Service to train ML models outside the features we provide; or submitting malware or unlawful content.
6. AI-generated output
Optional AI features produce text for entertainment and convenience. Output may be inaccurate or inappropriate. You use AI output at your own discretion. Do not rely on it for medical, legal, or safety-critical decisions. See our Privacy Policy for how prompts are processed.
7. Paid plans and subscriptions
If we offer paid plans, fees, renewal, cancellation, and refunds will be presented at purchase (including through Apple’s In-App Purchase system where applicable). To the maximum extent permitted by law, subscriptions and fees are subject to Apple’s terms when purchased through the App Store. We may change pricing with notice where required.
8. Third-party services
The Service may link to or integrate third parties (for example librarians, schools, or book databases). Their terms and privacy practices apply to your use of their services.
9. Intellectual property
Shelfling names, logos, and the Service’s look and feel are owned by us or our licensors. Except for the limited license in Section 4, no rights are granted to you.
10. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SHELFLING AND ITS AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF DATA, GOODWILL, OR PROFITS. OUR TOTAL LIABILITY FOR CLAIMS RELATING TO THE SERVICE IN ANY TWELVE-MONTH PERIOD IS LIMITED TO THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THAT PERIOD OR (B) FIFTY U.S. DOLLARS (USD $50). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN SUCH CASES OUR LIABILITY IS LIMITED TO THE MINIMUM PERMITTED BY LAW.
12. Indemnity
You will defend and indemnify Shelfling against claims arising from your misuse of the Service, your content, or your violation of these Terms, to the extent permitted by law.
13. Termination
You may stop using the Service at any time. We may suspend or terminate access for violations of these Terms or legal risk. Provisions that by nature should survive (disclaimers, limits of liability, indemnity) survive termination.
14. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, USA, excluding conflict-of-law rules. You agree that state or federal courts located in Delaware have exclusive jurisdiction for disputes, unless applicable consumer law in your place of residence requires otherwise—in which case you may have non-waivable rights.
15. Changes
We may modify these Terms. We will post updates here and change the “Last updated” date. Continued use after changes become effective constitutes acceptance. If you do not agree, stop using the Service.
